  1. Overview

Welcome to Popkal Foods at https://popkal.in. Throughout these terms, “we”, “us” and “our” refer to the business operating Popkal Foods.

These Terms of Service govern your use of our website and purchases from our store. Please read them together with our Privacy Policy, Shipping Policy, and Return and Refund Policy.

Nothing in these terms limits your rights under applicable Indian consumer protection laws.

  1. Website Use and Customer Information

You must be legally capable of entering into a binding contract to place an order. If you are a minor, a parent or legal guardian must place the order on your behalf.

Please provide accurate and complete contact, delivery and payment information. Keep your account credentials secure and notify us if you suspect unauthorised use.

You must not use our website for fraud, unlawful activities, infringement, or attempts to disrupt its security or operation.

  1. Products and Food Information

We sell makhana, dry fruits and other food products listed on our website.

Please review the product description, pack size, ingredients, allergen information, storage instructions and best-before or expiry information before purchase or consumption.

Natural products may vary in size, colour and appearance between batches. These variations do not affect your right to receive products that are safe, correctly described and of the promised quality.

Product images are illustrative. Any material difference in the product supplied will be addressed under our Return and Refund Policy and applicable law.

Do not consume products with damaged seals, signs of spoilage or other safety concerns. Contact us for assistance.

  1. Orders and Availability

Orders are subject to payment confirmation, stock availability and delivery serviceability.

If we cannot fulfil an order, we will contact you using the details provided. If payment has already been collected for an order we cancel, we will refund the amount paid for the cancelled items and any applicable shipping charges.

We will seek your agreement before supplying a substitute product or making a material change to your order.

  1. Prices and Payments

Prices are displayed in Indian Rupees (INR). Applicable taxes and shipping charges will be disclosed at checkout before payment. The total shown at checkout is the amount payable.

Standard shipping is ₹49 per order, unless a clearly disclosed offer applies.

Payments are processed through the payment providers available at checkout, including Razorpay. You must be authorised to use your selected payment method.

Price changes apply to future orders and do not change the agreed price of an accepted order.

  1. Shipping and Delivery

We ship across India, subject to courier service availability at your PIN code.

Orders are dispatched the next business day after confirmation. Sundays and public holidays are excluded from business days.

Estimated delivery is 5–8 business days after dispatch. Estimates may vary due to destination, weather, holidays or courier disruptions.

Please provide a complete delivery address and reachable contact number. Contact us if an order is delayed, missing or damaged. We will coordinate with the courier and arrange an appropriate resolution.

Handing a parcel to the courier does not remove our responsibility to address non-delivery or product issues in accordance with applicable law.

  1. Cancellations, Returns and Refunds

You may request cancellation before dispatch by contacting us promptly. Approved cancellations before dispatch will receive a full refund of the amount paid.

After dispatch, contact us for assistance. Change-of-mind returns are not accepted for food products for hygiene and food-safety reasons.

Damaged, spoiled, expired, incorrect or missing products are covered by our Return and Refund Policy. Please report issues promptly, preferably within 7 days of delivery. This reporting preference does not remove your statutory rights.

An unboxing video is not mandatory. We may request reasonable supporting information, such as an order number and available photographs.

Approved refunds will be initiated to the original payment method within 5 business days. Bank or payment-provider processing may take additional time.

  1. Bulk and Wholesale Orders

We welcome bulk and wholesale enquiries. Prices, quantities, dispatch schedules, shipping charges and other conditions for these orders will be agreed separately in writing before payment.

Any agreed wholesale terms apply only to the relevant order and do not remove rights that cannot lawfully be excluded.

  1. Intellectual Property

Our brand name, logo, website content and original designs belong to Popkal Foods or their respective rights holders.

Purchasing a product does not transfer ownership of our intellectual property. Unauthorised copying, misleading use of our brand or false claims of affiliation are prohibited.

  1. Shopify and Third-Party Services

Our store is hosted on Shopify. Purchases are made from the business operating Popkal Foods, rather than from Shopify.

Payment providers, couriers and other service providers support our operations. Their applicable terms may govern their services, without limiting our obligations to you.

  1. Privacy

Our Privacy Policy explains how personal information is collected, used and shared when you visit our website or place an order.

  1. Errors and Service Availability

We aim to keep product and pricing information accurate. If a material error affects your order, we will contact you to explain the issue and offer an appropriate resolution, including cancellation and refund where applicable.

Website access may occasionally be interrupted for maintenance or technical reasons.

  1. Liability and Consumer Rights

We remain responsible for obligations imposed by applicable law. Nothing in these terms excludes liability or remedies that cannot legally be excluded, including rights relating to unsafe, defective, misdescribed or undelivered products.

  1. Governing Law and Changes

These terms are governed by the laws of India. Nothing here restricts your right to approach a competent consumer commission, court or other authority.

We may update these terms by publishing a revised version with an updated date. Changes will not retrospectively reduce your rights for an existing order.
